Terms & Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all contracts concluded between
Igor Bukilic, operating under the brand Crazy Family Coffee,
sole trader (hereinafter referred to as the “Seller”),
and its customers via the Seller’s online shop.
Any deviating or conflicting terms and conditions of the customer shall not be recognized unless the Seller expressly agrees to their validity in writing.
The offer is primarily directed at consumers.
Contracts with entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) are also permitted.
2. Conclusion of Contract
The products presented in the online shop do not constitute legally binding offers but an invitation to submit an order.
By clicking the “Buy now” button, the customer submits a binding offer to conclude a purchase contract.
The contract is concluded only when the Seller accepts the order by sending an order confirmation by email or by dispatching the goods.
The contract is concluded exclusively in German or English.
3. Prices and Shipping Costs
All prices stated are final prices in euros.
The Seller is a small business within the meaning of §19 UStG; therefore, no VAT is charged.
Any additional shipping costs are transparently displayed during the checkout process.
Shipping costs depend in particular on:
- the destination country
- the weight and size of the order
and are calculated in a binding manner during checkout.
Free delivery within Germany may be granted from a certain order value.
Promotional shipping offers or minimum order thresholds (e.g., free shipping) may be limited to specific regions. Only the conditions and costs displayed during checkout are decisive.
Even if a promoted minimum order value is reached, additional shipping costs may apply due to weight or shipping method, provided this is indicated during checkout.
4. Delivery
Delivery is made to the delivery address specified by the customer during the ordering process.
Delivery is available to:
- Germany
- Countries of the European Union
Shipping is dispatched from Bavaria, Germany.
The delivery period begins after full payment has been received, unless another payment method explicitly provides otherwise.
Delivery times are stated separately on the website and represent non-binding guidelines unless expressly agreed otherwise.
Delays caused by shipping service providers, force majeure, or other circumstances beyond the Seller’s control do not entitle the customer to claims for damages, unless mandatory statutory provisions provide otherwise. Partial deliveries are permitted if reasonable for the customer.
Undeliverable Shipments
If the goods are returned due to an incorrect or incomplete delivery address provided by the customer, failure to collect the shipment, or refusal of acceptance, the customer shall bear the resulting shipping costs.
The Seller reserves the right to withdraw from the contract after a reasonable period. A renewed delivery will only be made after the customer has covered the additional shipping costs.
Transfer of Risk for Business
Customers If the customer acts as an entrepreneur within the meaning of §14 BGB, the risk of accidental loss or deterioration of the goods passes to the customer upon handover to the shipping service provider.
5. Payment Terms
Payment is made exclusively via the payment methods offered in the online shop, in particular:
- Stripe
- PayPal
- Apple Pay
- Google Pay
The purchase price is due upon conclusion of the contract.
If an immediately available payment method is selected, the charge will be made directly after completion of the order. Delivery will only take place after successful receipt of payment, unless otherwise specified for the respective payment method.
The Seller reserves the right to exclude individual payment methods in specific cases.
6. Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal.
The details, conditions, deadlines, and exercise of the right of withdrawal are governed exclusively by the separate withdrawal policy, which is made available to the customer during the ordering process and on the Seller’s website.
Where legally permissible, the customer bears the direct costs of returning the goods.
7. Returns and Damaged Goods
Unannounced returns may be rejected.
In the event of a damaged or defective delivery, the customer must inform the Seller without undue delay and document the damage with appropriate evidence (e.g. photos).
Further details on returns and exclusions are set out in the Return Conditions and the Withdrawal Policy.
8. Retention of Title
The goods remain the property of the Seller until full payment of the purchase price has been made.
9. Warranty
The statutory warranty rights shall apply.
Obvious transport damage should be reported by the customer directly to the carrier where possible and communicated to the Seller without delay.
Customers are requested to document any visible transport damage where possible (e.g., by photos) in order to enable prompt processing.
Failure to provide such notification or documentation does not affect the customer’s statutory warranty rights.
10. Liability
The Seller shall be liable without limitation in cases of intent or gross negligence. In cases of simple negligence, the Seller shall only be liable for the breach of essential contractual obligations (cardinal duties) and limited to the foreseeable, typical contractual damage.
Liability for indirect damages, consequential damages, or loss of profit is excluded to the extent legally permissible.
Liability for delivery delays or transport damage caused by the shipping service provider is excluded to the extent legally permissible and provided that no mandatory consumer protection provisions apply.
11. Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the country of their habitual residence.
12. Place of Jurisdiction
If the customer is a merchant, a legal entity under public law, or an entrepreneur, the exclusive place of jurisdiction shall be the Seller’s place of business.
13. Severability Clause
Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by the applicable statutory provision.
